Wage Benefits

What are Wage Benefits for Injured Workers?

Under Georgia workers' compensation law, injured workers who have missed seven consecutive days of work due to an on-the-job accident or work-related injury are entitled to wage benefits.

Effective Representation for Injured Workers in Georgia

If you miss more than 21 consecutive days of work, you will be paid wage benefits for the first seven days off the job. You can expect your first weekly check in the mail within 21 days after the first day of work you missed.

How Much Will You Receive?

The workers' compensation wage benefit is two thirds of your average weekly wages, based on the wages you received for the 13 weeks prior to your accident. To determine your average weekly wage, add the amount of wages or salary you earned in the 13 weeks before your accident. Then divide that number by 13. Multiply the result by two thirds (or .66) to learn how much your weekly total temporary disability benefit check will be.

You will receive this weekly check as long as your authorized doctor says that you are disabled for work-related injuries. Please note: There is a cap on these weekly wages that changes every year.

Getting the Numbers Right

At the Law Offices of Gary Martin Hays & Associates, our attorneys have found that injured workers are often not paid the correct amount. We will obtain your work records and determine exactly how much you are entitled to receive in wage benefits. Then we advocate aggressively on your behalf. We will make the insurance company uphold its end of the bargain and pay you everything you deserve under Georgia law.

It is important to report your injury as soon as possible, so you can begin receiving your workers' compensation wage benefits.
